Inquiry – Apprentice Jockey Doctor Lembethe

The National Horseracing Authority confirms that at an inquiry held in Durban on 11 March 2011, Apprentice Jockey Doctor Lembethe was charged with a contravention of Rule 62.2.7, in that as the rider of ROCKVALE, he failed to ensure that he did not cause interference to other runners at approximately the 1100 metre mark in Race 8 at the Greyville Racecourse on the 8 March 2011.

Mr Lembethe pleaded not guilty to the charge.

The Inquiry Board found Mr Lembethe guilty of the charge and imposed a penalty of a suspension from riding in races for a period of one week.

Mr Lembethe has the right of appeal against the finding and the penalty imposed.

Inquiry – Jockey Derreck David

The National Horseracing Authority confirms that at an inquiry held in Johannesburg on 15 March 2011, Jockey Derreck David was charged with a contravention of Rule 62.2.7, in that as the rider of ROYAL ARROW (AUS), he failed to ensure that he did not cause interference to other runners at approximately the 150 metre mark in Race 7 at the Turffontein Racecourse on 12 March 2011.

Mr David pleaded guilty to the charge.

The Inquiry Board found Mr David guilty of the charge and imposed a suspension from riding in races for a period of ten days.

Mr David has the right of appeal against the penalty imposed.

Inquiry –  Owner E D Testa

The National Horseracing Authority confirms that at an inquiry held in Durban on 16 March 2011, Owner E D Testa was charged with a contravention of Rule 72.1.19, in that he committed a dishonest and prohibited practice in relation to racing, in that he altered and submitted to the NHA a registration of ownership form that had been issued by the TBA, to reflect the details of the horse TRADE BAN and thereby to register the horse TRADE BAN in his name.

Mr Testa pleaded guilty to the charge.

The Inquiry Board found Mr Testa guilty and fined him the sum of R10 000.

Mr Testa has the right of appeal against the penalty imposed.

Inquiry – Apprentice Jockey Brandon Lerena

The National Horseracing Authority confirms that at an inquiry held in Durban on 11 March 2011, Apprentice Jockey Brandon Lerena was charged with a contravention of Rule 62.2.7, in that as the rider of OUTBACK KING, he failed to ensure that he did not cause interference to other runners at approximately the 150 metre mark in Race 8 at the Scottsville Racecourse on 1 March 2011.

Mr Lerena pleaded guilty to the charge.

The Inquiry Board found Mr Lerena guilty and imposed a penalty of a suspension from riding in races for a period of one week.

Mr Lerena waived his right of appeal and requested to take his suspension from 12 March to 18 March 2011, both days inclusive.

Inquiry –  Apprentice Jockey Gareth Wright

The National Horseracing Authority confirms that at an inquiry held in Cape Town on 29 March 2011, Apprentice Jockey Gareth Wright was charged with a contravention of Rule 21.11, in that he failed to ensure that he carried the correct weight for DANISH DIVA during the running of this race by weighing in more than 0,5kg below the weight at which he was declared out.  This resulted in DANISH DIVA, the winner of Race 5, at the Kenilworth Racecourse on 23 March 2011, being disqualified following a Clerk of the Scales Objection being upheld.

Mr Wright pleaded not guilty to the charge.

The Inquiry Board found him guilty of the charge and imposed a penalty of a suspension from riding in race meetings for a period of 12 weeks, 6 weeks of which is wholly suspended for a period of 2 years, provided that Mr Wright is not charged with and found guilty of a similar offence pertaining to weighing in underweight during that period.

Mr Wright has the Right of Appeal against both the finding and the penalty imposed.
