NHA Breaching Rules?

I read the appraisal of Adv Brett Maselle on the “Mayfair” situation with great interest, writes Ian Jayes via email in the Sporting Post mailbag.

It would appear that there has been an ongoing breach of their own Rules by the NHA.

As a layman without legal training or qualifications, I am curious to know, if in its Affidavit to the High Court in Cape Town, ABSA stated that Mayfair was “hopelessly insolvent” how has an insolvent company been allowed to still have racing colours, trade and incur expenses?

I would like to hear Adv Brett Maselle’s take on this as well.
