NHA Clarifies Khumalo Conditions

National Horseracing AuthorityOn 25 March 2014, the NHA issued a press release regarding the outcome of Jockey S’manga Khumalo’s appeal hearing. In it, they referred to “strict timelines and conditions” that had been laid down for the launching of Jockey Khumalo’s High Court application.  Following a number of inquiries regarding the specifics of the conditions, the NHA issued the following clarification earlier today:-

1. Mr Bloomberg, the legal representative of Jockey Khumalo, had to confirm in writing that he holds instructions to bring a High Court Review Application – this has been complied with.

2. The Review Application is to be launched 30 calendar days from the date on which the record of the Appeal Hearing and the reasons for the Appeal Board’s decision are made available to Mr Bloomberg. It is anticipated that these documents will be made available within the next two days.

3. Thereafter the Review Application will proceed as provided for in the High Court Rules.

4. In the event of the Review Application not being launched as required within the 30 day period, the suspension imposed on Jockey Khumalo will become effective immediately.
